Welcome to ApexDrift B.V. ("ApexDrift", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our fitness centre facilities, services, and website located at apexdrift.top (collectively, the "Services").

By accessing our facilities, using our services, or browsing our website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and ApexDrift B.V., a company registered in the Netherlands with registration number NL65382741.

About ApexDrift

ApexDrift operates a fitness centre located at Beukenlaan 276, 4831 NH Breda, Netherlands. We provide fitness facilities, personal training services, group classes, and related wellness services to our members and visitors.

Membership and Services

Membership Requirements

• Members must be at least 16 years of age
• Members under 18 require parental or guardian consent
• Valid identification must be provided upon registration
• Health questionnaire and waiver must be completed
• Membership fees must be paid according to the agreed schedule

Facility Access

• Access is granted only during designated operating hours
• Valid membership or day pass is required for entry
• Members must present valid identification when requested
• Facility access may be suspended for non-payment or violation of rules
• We reserve the right to refuse entry for health, safety, or conduct reasons

Service Limitations

Our services are subject to availability and may be modified, suspended, or discontinued at any time. We strive to provide advance notice of any significant changes to our services or facilities.

Personal training sessions, group classes, and specialised services may require advance booking and are subject to additional terms and conditions.

User Obligations

Facility Rules and Conduct

All members and visitors must adhere to our facility rules and conduct guidelines:

• Follow all posted safety guidelines and equipment instructions
• Maintain appropriate hygiene and dress code standards
• Treat staff, other members, and facilities with respect
• Report any equipment malfunctions or safety concerns immediately
• Clean equipment after use and return weights to designated areas
• Refrain from disruptive behaviour, including excessive noise
• Comply with all applicable laws and regulations

Health and Safety Responsibilities

• Ensure you are physically capable of participating in fitness activities
• Consult with healthcare providers before beginning any exercise programme
• Inform staff of any medical conditions that may affect your safety
• Use equipment properly and within your physical capabilities
• Follow all emergency procedures and evacuation instructions

Prohibited Activities

The following activities are strictly prohibited on our premises:

• Use of illegal substances or being under the influence of alcohol or drugs
• Harassment, discrimination, or inappropriate behaviour towards others
• Photography or video recording without explicit permission
• Solicitation, sales, or commercial activities without authorisation
• Bringing unauthorised guests or allowing others to use your membership
• Damage to property or equipment
• Any activity that compromises safety or disrupts others

Payment Terms

Membership Fees

• Membership fees are due according to your chosen payment schedule
• All fees must be paid in advance of the service period
• Late payment may result in suspension of membership privileges
• Additional charges may apply for personal training and specialised services
• Prices are subject to change with 30 days' written notice

Refund Policy

Membership fees are generally non-refundable except as required by law or in exceptional circumstances at our discretion. Refund requests must be submitted in writing and will be considered on a case-by-case basis.

For personal training sessions and other services, cancellation policies apply as specified in your service agreement.

Intellectual Property

All content on our website and materials provided by ApexDrift, including but not limited to text, graphics, logos, images, videos, software, and training programmes, are the intellectual property of ApexDrift B.V. or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Permitted Use

• You may view and use our website for personal, non-commercial purposes
• You may download and print materials for your personal fitness use
• You must retain all copyright and proprietary notices

Prohibited Use

• Commercial use or distribution of our content without written permission
• Modification, copying, or creation of derivative works
• Reverse engineering or attempting to extract source code
• Removing or altering copyright or proprietary notices
• Using our trademarks or branding without authorisation

Limitation of Liability

To the fullest extent permitted by law, ApexDrift B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of our services or facilities.

Specific Limitations

• We are not liable for injuries resulting from improper use of equipment
• We are not responsible for lost, stolen, or damaged personal property
• We do not guarantee specific fitness results or outcomes
• We are not liable for service interruptions or facility closures
• Our total liability is limited to the amount of fees paid by you in the 12 months preceding the claim

Assumption of Risk

You acknowledge that physical exercise and use of fitness equipment involves inherent risks of injury. By using our services, you voluntarily assume these risks and agree to participate at your own risk.

You are responsible for ensuring that you are physically capable of participating in fitness activities and should consult with healthcare professionals as appropriate.

Indemnification

You agree to indemnify, defend, and hold harmless ApexDrift B.V., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:

• Your use of our services or facilities
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your negligent or wrongful conduct
• Any damage you cause to our property or equipment

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Termination

Termination by You

You may terminate your membership at any time by providing written notice according to your membership agreement terms. Termination will be effective at the end of your current billing period, and you remain responsible for all fees incurred up to the termination date.

Termination by ApexDrift

We may terminate or suspend your membership immediately, without prior notice, for any of the following reasons:

• Violation of these Terms or facility rules
• Non-payment of fees
• Conduct that endangers safety or disrupts operations
• Fraudulent or illegal activity
• Breach of any agreement with ApexDrift

Effect of Termination

Upon termination, your right to use our facilities and services will cease immediately. Any outstanding fees remain due and payable. Sections of these Terms that by their nature should survive termination will continue to apply.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "last updated" date. Continued use of our services after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must discontinue use of our services and may terminate your membership according to the termination provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional service agreements, constitute the entire agreement between you and ApexDrift regarding the use of our services and supersede all prior agreements and understandings.
